- Introduction and Acceptance
These terms govern your use of the CanolioGourmet platform as a client. By navigating the website and booking our services, you agree to these terms. Review our Privacy Policy, which is incorporated herein. If you do not agree, you may not use the platform or the services.
- Definitions
- Canolio Gourmet (CG): The company operating the platform.
- Platform: Online marketplace where CG connects clients with chefs.
- Chef: Independent service provider offering culinary services specializing in cannabis-infused meals. The chef is not an employee, agent nor a representative of CG.
- Client: Individual or group who books services through CG.
- Booking: Confirmed agreement for service at a specific time and location.
- Offer: Proposal from a chef provided by CG to the client, including menu, pricing, and details.
- Client Requirements
By requesting a chef for cannabis-infused meal preparation, the client acknowledges and accepts the following:
Assumption of risk: The client understands that the consumption of cannabis-infused food carries potential effects and risks. By choosing this service, the client voluntarily assumes all responsibility for their personal health, safety and actions during and after the event.
Limitation of liability: Neither Canolio Gourmet nor the chef shall be held responsible or liable for any adverse reactions, health issues, accidents or incidents resulting from the consumption of cannabis-infused meals.
Respect: No guest shall be pressured or coerced into consuming cannabis-infused food.
Legal compliance: The client agrees to comply with all applicable local, state, provincial and federal cannabis regulations. Cannabis-infused meals will only be served where legally permitted. The client confirms they are of legal age to consume cannabis in their jurisdiction.
Safe conduct: The client agrees not to operate a motor vehicle or engage in any activity requiring alertness while under the influence of cannabis. CG and the chef are not responsible for monitoring guest consumption or ensuring safe transportation. The client is responsible for arranging appropriate transportation for themselves and their guests if needed.
Release of claims: By booking a cannabis-infused dining experience, the client releases CG and the chef from any and all claims, damages, liabilities or legal actions arising from participation in the event.
- Relationship with Chefs
Operations: Clients enter direct agreements with chefs. CG acts solely as an intermediary.
Communication: Communication must always be respectful.
Non-Discrimination: No discrimination against clients or other clients is permitted.
- Booking and cancellation
Bookings: Confirmed bookings are binding. Cancellations should occur only in emergencies. Clients must notify CG immediately. Last-minute cancellations will incur penalties. Cancellations made more than 8 days before the event are reimbursed in full less administration fees. Cancellations received 7 days or less before the event are reimbursed at 50% less administration fees.
Payments: Payments are processed by Canolio Gourmet.
Changes: Clients must notify Canolio Gourmet immediately of any changes.
Client no-show: No reimbursement will be provided for client no-shows.
- Client Responsibilities: quality, insurance and compliance
Kitchen and Equipment: The client must provide a safe, functional and adequately equipped kitchen, including all necessary appliances, tools and facilities for meal preparation. The client is responsible for ensuring that the environment meets basic health and safety standards. Most of the time, the chef will bring some personal equipment.
Insurance: The client must carry appropriate event or liability insurance. Canolio Gourmet may request proof of coverage before confirming services. The client acknowledges that failure to carry adequate insurance increases personal responsibility in case of accidents, damages or claims.
Legal compliance: The client agrees to comply with all applicable laws and regulations, including but not limited to cannabis regulations, possession limits, legal age, permitted use and transportation laws including not driving under the influence of cannabis. Failure to comply with these requirements may result in cancellation of services without refund and may expose the client to legal liability.
- Policies and Restrictions
Values: Canolio Gourmet values ethics, goodwill, respect and trust.
Non-Discrimination: No discrimination against chefs or other clients is permitted.
Confidentiality: CG will not disclose client information nor will the chefs.
System abuse: No fake reviews or manipulation of ratings or referrals are permitted.
Reporting: Notify CG promptly of any incidents during services.
- Dispute Resolution and Governing Law
No Disputes: By booking, the client agrees not to pursue claims against CG nor the chef.
Insurance: The client must hold valid event and liability insurance covering themselves and all guests.
Governing law: This agreement is governed by the laws of Canada.
Jurisdiction: The courts of Québec, Canada have exclusive jurisdiction with CG reserving the right to seek injunctive relief in other courts if necessary.
Informal resolution: Clients are encouraged to contact CG support to resolve issues amicably before pursuing legal action.
Optional arbitration: With mutual consent, disputes may instead be resolved by binding arbitration.
Time limit: Any claim must be filed within two days of the event. Claims filed after this period are permanently barred.
